Prosthetic Eyeball Falls Out in Court, Causes Mistrial

The trial of Commonwealth v. Brunelli, like any court trial, is extremely stressful. When a witness broke into tears under the pressure of a testifying about his injuries to a jury his tears caused his fake eye to fall out, setting this stressful trial back the a few years.

Huttick, 48, was on the witness stand Wednesday, weeping as he told the Common Pleas Court jury about the impact of losing an eye when he literally lost his eye.

“I couldn’t believe it just came out,” said Huttick after Judge Robert P. Coleman granted the mistrial motion by defense attorney Eileen Hurley.

Coleman set a new trial for March 4 and, with judicial understatement, declared it an “unfortunate, unforeseen incident.”

Take note that that preemptive, classic “too-soon” description of this situation as being “an unforeseen incident” was a low-brow shot for which I am not responsible, though I respect their candidness.

It’s great to see the law being upheld so well. Just because someone is stabbed in the eye after a bar fight, that doesn’t mean the trial of that person can be open-season for tears and empty eye socket. It’s misleading the jury into believing that losing half of your sight is emotionally upsetting.
